Consumer notice: This is a limited warranty. It gives you specific legal rights, and you may also have other rights that vary by state. This warranty does not limit any right that cannot be limited under applicable law. Keep a copy of this warranty and your proof of purchase.
1. Warrantor and Coverage Period
This One-Year Limited Warranty is provided by Notari Labs Inc., a Delaware corporation, with a business address at 1209 ORANGE STREET, Wilmington, DE 19801, United States ("Notari"). It covers an eligible Notari-branded hardware device for one year beginning on the date the original end-user purchaser receives it.
2. Who and What Is Covered
This warranty applies only to the original end-user purchaser, is not transferable, and covers a new Notari-branded hardware device purchased directly from Notari or an authorized Notari sales channel in the United States. Proof of purchase and the device serial number may be required. It covers defects in materials or workmanship arising under normal use in accordance with Notari’s published instructions during the warranty period.
3. Exclusive Warranty Remedies
If Notari confirms a covered defect, Notari will, at its option and to the extent permitted by law: (a) repair the product using new or previously used genuine parts that meet functional requirements; (b) replace it with a new or refurbished product of the same model or one with substantially equivalent or better functionality; or (c) refund the original product purchase price if repair or replacement is not commercially reasonable. These are the remedies provided by this limited warranty.
A repaired or replacement product is covered for the longer of the remaining original warranty period or 90 days after it is returned to you. A replacement may differ cosmetically or use functionally equivalent components. A replaced product or part becomes Notari’s property when the replacement or refund is provided.
4. How to Obtain Warranty Service
- Contact support@notarilabs.com before the warranty expires and provide the order information, serial number, a description of the issue, and reasonably requested photos, logs, or diagnostic results.
- Complete reasonable troubleshooting and follow the return merchandise authorization (RMA), packaging, and shipping instructions. Do not send a product without authorization.
- Back up and remove data, unlink accounts, disable security locks, and factory-reset the device if instructed and reasonably possible. Warranty service may erase all content and settings.
- For a confirmed covered claim within the United States, Notari will provide or reimburse reasonable standard return shipping. Expedited shipping, packing services, and unauthorized shipping costs are not covered.
Notari may require the product to be returned before providing a remedy. If inspection shows that the issue is not covered, Notari may return the product and may charge diagnostic, shipping, or repair amounts only after disclosing them and obtaining any consent required by law.
5. What This Warranty Does Not Cover
This warranty does not cover a problem or damage caused by or resulting from:
- normal wear and tear, cosmetic scratches, dents, discoloration, or finish changes that do not affect functionality;
- normal depletion or aging of a battery, unless a battery fails because of a covered defect;
- accident, drop, impact, collision, crushing, bending, abnormal mechanical shock, loss, or theft;
- liquid exposure, immersion, rain, excessive moisture, condensation, corrosion, or operation outside a published water-resistance rating;
- fire, excessive dust, sand, chemicals, power surge, lightning, natural disaster, or another external event beyond Notari’s reasonable control;
- use, charging, storage, or transport at temperatures, humidity levels, altitudes, voltages, or other conditions outside Notari’s published operating specifications;
- an improper, incompatible, counterfeit, damaged, or noncompliant charger, power supply, battery, cable, connector, port, voltage, or electrical source;
- misuse, abuse, neglect, improper storage, lack of reasonable care, or use contrary to documentation, warnings, or intended purpose;
- installation, modification, disassembly, repair, or service by a person not authorized by Notari, but only to the extent that action caused or contributed to the claimed problem;
- a third-party product, service, accessory, part, software, or network that is incompatible or defective, but not the mere use of a third-party item that did not cause or contribute to the problem;
- removed, altered, defaced, or unreadable serial numbers or authenticity markings;
- consumables, accessories, and separately warranted items unless expressly included;
- a prototype, beta, sample, demonstration, or evaluation unit identified as such;
- interruption or failure of wireless, internet, cloud, app-store, AI, or other third-party services; or
- loss, corruption, disclosure, restoration, or migration of recordings, transcripts, account information, software, or any other data.
6. Software, Services, and AI Features
This hardware warranty does not warrant software, subscriptions, cloud services, third-party services, or AI-generated output. Notari does not promise that a product or service will operate without interruption or error, that every device or network will remain compatible, or that a transcription, summary, speaker label, or other AI output will be complete or accurate. Separate terms may apply to software and services.
7. Implied Warranties
To the extent permitted by law, any implied warranty—including implied warranties of merchantability and fitness for a particular purpose—is limited in duration to the one-year period of this written warranty. Some states do not allow limits on how long an implied warranty lasts, so this limitation may not apply to you. Notari does not disclaim an implied warranty to the extent such a disclaimer is prohibited by the Magnuson-Moss Warranty Act or other applicable law.
8. Limitation of Damages
To the maximum extent permitted by law, Notari is not liable under this warranty for incidental, special, indirect, exemplary, punitive, or consequential damages; loss of revenue, profits, business opportunity, or goodwill; substitute equipment or services; or loss, corruption, or recovery of data. Some states do not allow the exclusion or limitation of incidental or consequential damages, so these exclusions may not apply to you.
Nothing in this warranty excludes or limits liability for fraud, willful misconduct, death or personal injury where liability cannot be excluded, or any other liability or consumer remedy that applicable law does not permit Notari to exclude or limit. Expiration of the warranty ends the right to free warranty service; it does not eliminate a separate liability that cannot lawfully be excluded.
9. No Unauthorized Modifications
No reseller, agent, employee, or other person may modify or extend this warranty on Notari’s behalf unless the modification is in a written agreement signed by an authorized Notari representative.
10. Geographic Scope
This version is intended for products sold for use in the United States. Warranty service is currently available only in the United States. Product availability and warranty terms may differ when Notari formally launches in another country.
